Terms of Use

Last updated October 12, 2026

These terms apply to your access to and use of the website operated by Momentum Construction & Development LLC (“MCD,” “we,” “us,” or “our”). By using the website, you agree to these terms. If you do not agree, do not use the website.

Website information is general

Website content is provided for general information about MCD and its services. Viewing the website, submitting an inquiry, or receiving a response does not by itself create a contractor-client relationship, professional engagement, accepted bid, construction agreement, or commitment by MCD to perform work. A project begins only under a separate written agreement signed by the parties with an authorized MCD representative.

Project-specific written agreements control

Any construction or consulting services are governed by the applicable signed, project-specific agreement, including its scope, price, payment schedule, allowances, change-order process, schedule, insurance, warranty, dispute provisions, and other terms. Nothing on this website changes a signed agreement or limits rights and duties that applicable law does not permit a party to waive.

Estimates, schedules, permits, and project images

Descriptions, examples, photographs, renderings, and project summaries are illustrative and may omit project-specific details. They do not promise that another project will have the same appearance, price, schedule, construction method, permit outcome, or result. Construction costs and schedules depend on scope, existing conditions, design decisions, material availability, agency review, weather, and other factors. No estimate, budget range, schedule, or permit discussion on this website is a binding offer unless incorporated into a signed written agreement.

Acceptable use

You may use this website for lawful personal or business purposes. You agree not to interfere with its operation or security, attempt unauthorized access, introduce malicious code, scrape or harvest information in a manner that violates law or others’ rights, or use the site to transmit unlawful, deceptive, or harmful material.

Ownership and limited permission

Unless otherwise identified, website text, design, branding, and images are owned by MCD or used with permission and are protected by applicable intellectual-property laws. You may view and print pages for your own informational use. You may not reproduce, modify, distribute, or commercially exploit site content without prior written permission, except as permitted by law. Third-party names and marks belong to their respective owners.

Third-party links

Links to third-party websites are provided for convenience. MCD does not control or endorse all content, products, services, security, or privacy practices on those sites and is not responsible for them. Your use of an external site is subject to that provider’s terms and policies.

Availability and corrections

We may update, suspend, or remove website content at any time. We aim to keep information useful, but do not promise that every page will always be available, current, complete, or error-free. Contact MCD directly to confirm information relevant to a specific project.

Liability and nonwaivable rights

To the extent permitted by applicable law, MCD is not responsible for losses arising from reliance on general website content, temporary unavailability, or third-party websites. Nothing in these terms excludes or limits liability or a remedy that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, or other nonwaivable rights under California law. These terms do not waive statutory consumer protections or accessibility rights.

Governing law and changes

California law governs these terms, without regard to conflict-of-law rules, except where another law must apply. These terms concern website use only; they do not establish an exclusive venue or dispute process for a construction project. We may revise these terms by posting an updated version with a new revision date. Your continued use after a revision constitutes acceptance to the extent permitted by law.
